RETREAT TERMS OF SERVICE & PARTICIPANT AGREEMENT
Please read the following carefully! In exchange for being allowed to participate in any of our Retreats, you agree to be bound to the following Retreat Terms of Service (“Retreat Terms of Service”).
These retreats are organized by The Dailey Method LLC, a Limited Liability Company operating out of the State of California (“Dailey Travel + Wellness”). Dailey Travel + Wellness may modify, amend, supplement and replace the Terms of Service at any time without providing you with advance notice.
- What to Expect During Our Retreats. Dailey Travel + Wellness will provide you with aligning and relaxing Retreats. Our Retreats include:
- Fitness (barre, yoga, Thrive), mindfulness, and meditation workshops. Optional Individual and group sessions are available.
- What We Expect of You. Here is what we expect of you as a participant in our Retreats to ensure the best possible experience for everyone:
- Respect: You agree to always be mindful and respectful of other participants, instructors and facilitators during the Retreat.
- Responsibility: You are responsible for your own physical, mental and emotional well-being, actions and overall self-care during the Retreat.
- Disclosure: We expect you to disclose any relevant physical, medical or mental health issues.
- Time Integrity: You can participate in as many or as few offerings as you'd like, but we ask that, as a courtesy to your fellow attendees and your hosts, please show up on time for the activities you are joining.
- Presence: This is your opportunity to Retreat. The hotel has no cell service, and wi-fi is not strong or reliable. We invite you to unplug.
- Termination: Once you have committed, both you and Dailey Travel + Wellness can terminate the agreement at any time. Alternatively, if both parties agree to end the relationship at once, that will be binding. Upon termination, all cancellation and refund policies will apply.
- If you violate any of the expectations outlined above, Dailey Travel + Wellness may terminate this Agreement effective immediately, and you will not be entitled to refunds or a continued working relationship with Dailey Travel + Wellness.
- Payment. To secure your spot, we will require a USD $700 non-refundable deposit at the time of booking. The balance is expected to be paid no later than three (3) months before the retreat starts.
- Refunds and Cancellation. Our refund policy is as follows:
- If you can no longer attend the retreat, we require eight (8) weeks notice to refund 75% of your second payment. For notice of less than eight (8) weeks but more than four (4) weeks, we will refund 25% of your second payment. Any notice less than four (4) will be non-refundable. The deposit will remain non-refundable.
- If Dailey Travel + Wellness is unable to facilitate the Retreat and it does not happen, we will refund the full amount received from you. However, the Organizer shall not be responsible for any additional fees paid by Guests to third parties, such as travel companies, etc.
- No Guarantees. Dailey Travel + Wellness will try to ensure that all participants have a wonderful experience but does not guarantee that anyone will get specific results from their participation.
- Ownership of Materials. All the content we have provided on the retreat, including but not limited to videos, documents and PDFs, is for the participants' use only and may not be re-distributed or re-used.
- Expectations and Behaviour. Being on a retreat means sharing space and energy with others. Dailey Travel + Wellness will not accept any rude, racist, sexist, or discriminatory behavior of any kind toward any person. If any participant displays any behavior that is found to be unacceptable, they will be asked to leave the Retreat immediately, at Dailey Travel + Wellness’ discretion and the participant's own expense, and they will not be welcome to participate in any Activities moving forward, nor refunded for any amounts they have invested in the Retreat. We operate in a safe place, and as such, any form of harassment, be it verbal or physical, is strictly prohibited. If any participant harasses anyone - Retreat staff or fellow participants, they will be asked to leave the Retreat immediately.
- Insurance. We highly recommend that all participants obtain travel insurance that covers their participation in the retreat activities. Insurance should cover things like trip interruption, cancellation charges, medical expenses and item loss. The organizer will not be responsible or liable for any loss, damage, expense, cost, or any other travel issue. Insurance is each participant's responsibility, and Dailey Travel + Wellness is not responsible for any of their costs.
- Additional items. Each participant is responsible for ensuring that they have valid travel documentation, such as passports, as well as any required and applicable travel visas, immunizations, or other required documentation for the locations being visited. Organizer will not be liable or responsible for any Guest being denied entry or exit to or from any location or country
- Assumption of Risks: Participation in the Retreat may involve risks, which may lead to tangible or intangible harm. Participants must agree that the Organizer is not liable, to the fullest extent permissible by law, for any harm that may come to them due to their participation in the Retreat.
- Retreat Waiver. All participants must sign our Retreat Waiver Agreement when joining any of our retreats.
- General Indemnity. Each participant will fully indemnify The Dailey Method and any of its members, directors, officers, employees, contractors, volunteers, agents, executors, administrators, successors, family members and assigns (the “Indemnified Parties”) and save harmless the Indemnified Parties from any losses, claims, damages, actions, causes of action, costs and expenses that an Indemnified Party may sustain, incur or suffer at any time, either during or after the Term, which are based upon, arising out of or occur, directly or indirectly, by reason of any act or omission by their in participating in the Retreat.
- Standard Legal Things. Choice of Laws and Venue. This Agreement will be governed exclusively by the laws of the State of California. The parties agree to irrevocably submit all claims to the exclusive jurisdiction of the courts of the State of California. Severability. If any provisions or terms of this Agreement are invalid or unenforceable, the other provisions and terms in the Agreement will remain in full force and effect. Entire Agreement. This Agreement constitutes the entire Agreement between the parties and replaces any prior agreements. Waiver of Breach. The waiver by me of any breach by you of any provision of this Agreement will not be taken to be a waiver of any further breaches by you. Counterparts. This agreement may be signed in any number of counterparts, each of which is an original, and all of which, taken together, constitute one single document. Online Agreement. We agree that this Agreement may be signed electronically or agreed to by having you click “I Agree” (or something similar), the effect of which will be the same as if we signed the Agreement by hand.
- Arbitration. Any controversy or claim arising out of or relating to this Agreement or the breach of this agreement shall be settled exclusively by arbitration. All parties agree that should arbitration take place, it will be exclusive to the courts of the State of California or such other arbitrator mutually agreed upon by the parties. The arbitrator’s decision shall be final, binding on both parties and enforceable in any court of competent jurisdiction. The losing party shall bear the costs of the arbitration. The arbitration award shall be final and binding upon the parties, and the parties hereby waive any rights to appeal or challenge the award, to the extent permitted by applicable law. This arbitration clause shall survive the termination or expiration of this contract.
